A subdivision trust indenture sets out the physical boundaries of the subdivision, describes the responsibilities and powers of the association, and details the rules and procedures by which the subdivision operates. Indentures are in place to protect the aesthetics and value of a neighborhood. Indentures are legally-binding, recorded documents recognized by the State of Missouri and recorded with the St. Louis County Recorder of Deeds Office. Indentures also dictate the process for electing subdivision trustees. Working under the constraints of the indenture, trustees oversee the collection of annual and special assessments, and oversee the maintenance of the subdivision. Explaining all these Rules… We encourage you to read your Enclaves HOA handbook and familiarize yourself with it. Our trustees and attorneys have spent countless hours fine-tuning our indentures so they pertain to us specifically as a neighborhood and benefit us as a group. All of our regulations are there for a reason — to keep the community tidy, appealing and uniform for the residents. Rules prevent unsightly scenes like cars rusting in driveways, purple garage doors and half-completed landscaping projects lingering for months. However, these rules can be daunting — the booklet may be hundreds of pages long. But most of the questions homeowners have about the rules are answered in your set of HOA guidelines. So, can you cut down that tree? It all depends on the HOA, City, etc… Rules vary widely from one HOA to another, so homeowners might be frustrated. Why can’t they do the same things they could at their last HOA? Be sure you get a copy of your HOA guidelines when you purchase your home, and we encourage you to read through them carefully. _______________________________________________________________________________________________________ Fees & Assessments The Enclaves at Cherry Hills subdivision levies annual fees and assessments to maintain common land and facilities in the subdivision and to enhance the quality of life for our residents. We elect a Board of Trustees and they collect and manage the funds on an annual basis. Annual fees are typically used for such expenses as cutting grass and maintaining landscaping on common ground and cul-de-sacs, pool maintenance, lake maintenance, subdivision signage, providing street lighting, duplicating and mailing subdivision announcements and meeting notices, supporting block parties and other subdivision-sponsored social events, and hiring attorneys or other professional services. Special assessments may be levied periodically and are typically used for major capital improvements, such as replacement or improvements to subdivision signage, fencing, detention facilities, retaining walls, and recreational facilities. ____________________________________________________________________________________________Wildwood Municipal Code
